Terms and Conditions

The agreement covering accounts, fair play, purchases, and platform availability.

01Who We Are

OVERCHARGE is operated by Momentum Cloud Pty Ltd (ABN 36 145 339 037), an Australian company, referred to in these terms as "we", "us", or "our".

Momentum Cloud Pty Ltd is the party responsible for the platform, your account, and any purchases made through it.

02Acceptance

By creating an account, downloading the client, or playing OVERCHARGE, you agree to these Terms and Conditions with Momentum Cloud Pty Ltd.

If you do not agree, do not use the platform.

03Accounts

You are responsible for your account credentials and all activity under your account.

One person, one account. Account selling, sharing, boosting for others, and smurfing to manipulate ratings are prohibited.

You must be at least 13 years old, or the minimum digital consent age in your country, to hold an account.

04Fair Play

Cheats, aimbots, macros, packet manipulation, exploit abuse, and unauthorised third-party clients are prohibited.

Harassment, hate speech, threats, and intentional match sabotage are prohibited in text, voice, and display names.

We may restrict, suspend, or permanently ban accounts that breach these rules, with or without prior notice.

05Virtual Credits and Purchases

Credits and cosmetic items are a limited licence to use digital content within OVERCHARGE. They have no cash value and cannot be traded outside the platform.

Purchases are final except where refund rights apply under the law of your country or the storefront you purchased through.

We may adjust prices, retire items, or change balance and cosmetic behaviour as the game evolves.

06User Content

You keep ownership of clips, screenshots, and other content you create, and you grant us a non-exclusive licence to host and promote content you submit to our channels.

You must not upload content that is unlawful, infringing, or abusive.

07Availability

The platform is provided on an as-is basis. Matchmaking, servers, seasons, and features may change, be interrupted, or be discontinued.

We aim to announce planned downtime, but we do not guarantee uninterrupted service or specific latency.

08Liability

To the extent permitted by law, we are not liable for indirect or consequential losses, lost progress, or lost virtual items.

Nothing in these terms limits rights that cannot be limited under applicable consumer law, including the Australian Consumer Law.

09Governing Law

These terms are governed by the laws of New South Wales, Australia, and you and Momentum Cloud Pty Ltd submit to the non-exclusive jurisdiction of its courts.

10Changes and Contact

We may update these terms. Material changes will be announced in the client or on this site before taking effect.
